Hiring an Indian marketing agency from the US: what changes

The time difference is a real constraint rather than a detail, and the regulatory surface is wider than most offshore teams expect. Both are solvable.

Hiring an Indian marketing agency from the US works, and it fails for different reasons than the UK version of the same arrangement. The time difference is genuinely awkward rather than merely inconvenient, and the regulatory surface is broader and more fragmented.

Both are manageable. Neither is manageable by accident.

The overlap problem, stated honestly

India is nine and a half to twelve and a half hours ahead of the US depending on coast and season. With the East Coast, an Indian team working late and an American team working early share a couple of hours. With the West Coast, there is effectively no natural overlap at all.

Agencies solve this three ways, and it is worth knowing which you are being sold. Some run a shifted team, where a few people work US hours — this is the real solution and it costs more. Some run an asynchronous process, where decisions are written down and nothing waits on a call; this works well for execution and badly for anything urgent. Some promise overlap and deliver a tired account manager on a 10pm call, which lasts about four months.

Ask which of the three it is, and ask what happens when an ad account is disabled on a Friday afternoon your time. We wrote about managing this in working with an offshore media buyer.

Special ad categories, before anything else

If you sell anything touching housing, employment or credit, Meta's special ad categories strip most targeting: no age or gender selection, limited interest targeting, and a minimum location radius far wider than most local advertisers want. Lookalikes are replaced by a restricted equivalent.

An agency that discovers this in week three has cost you a month. Ask about it in the first call. The detail is in why your US targeting disappeared.

State privacy law and the conversion data

The US does not have one privacy law; it has a growing patchwork of state ones. Several require that opt-out signals such as Global Privacy Control are honoured, which browsers increasingly send by default.

The practical consequence is not a fine. It is that reported conversions fall while actual revenue does not, and if nobody understands why, the agency gets blamed for a measurement change. An agency that works in the US should raise this before you see it in a dashboard — the mechanics are in why your US conversions fell.

Related: if your leads will be called or texted, the consent wording on the form is a legal matter with active litigation around it, and it is your lawyer's job rather than your agency's. What belongs on the form is set out in US lead form consent wording.

Contract and payment

Insist that you own the ad accounts, the pixel, the data and anything produced. Agree a reciprocal notice period. Specify which state's law governs the contract and where disputes are heard, because the default in an agency's template will not be yours.

On payment: services exported from India to a US business are generally outside Indian GST, you will likely need a W-8BEN-E from the agency for your own records, and whether withholding applies depends on the treaty position and the nature of the service. Those are general positions, not advice — have your accountant confirm the treatment before the first invoice. The mechanics are in paying an Indian agency from overseas.

What to agree with an Indian marketing agency in week one

  1. A fixed daily window when a named person is reachable in your hours.
  2. Where decisions are written down, so nothing depends on remembering a call.
  3. An escalation path for account suspensions and billing failures, with a response time.
  4. Who owns consent wording, privacy compliance and claims substantiation — the answer should be your side, with the agency flagging issues.
  5. One number you both judge the engagement on, defined precisely enough that neither of you can reinterpret it in month four.

How we structure this for American clients is on the USA page, and the broader market-entry version — for Indian brands going the other way — is in selling into the US from India.

Questions people ask before hiring

How do you manage the time difference with an Indian agency?

Three ways, and you should know which you are buying: a genuinely shifted team working US hours, which costs more; a disciplined asynchronous process where decisions are written rather than discussed; or an account manager taking late calls, which rarely lasts.

What US-specific rules should the agency already know?

Meta special ad categories for housing, employment and credit; state privacy laws and Global Privacy Control, which quietly reduce reported conversions; and the fact that lead form consent wording for calls and texts is a legal matter for your attorney rather than the agency.

Who should own the ad accounts?

You, in your own Business Manager and Google Ads account, with the agency added as a user. This protects the history, the pixel data and the audiences, and it makes a change of agency an administrative event rather than a rebuild.

How do payments to an Indian agency work?

Services exported from India are generally outside Indian GST, and you will usually want a W-8BEN-E on file. Whether withholding applies depends on the treaty position and the nature of the service, so confirm the treatment with your accountant first.
