Hiring an Indian marketing agency from the UK is common enough now that the interesting questions are no longer about whether it works. They are about the specific things that make it work or quietly fail, and most of them are not price.
Here is what to check, in the order it tends to matter.
The overlap is better than people expect
India runs four and a half hours ahead of the UK in winter and four and a half ahead of BST in summer. A team working Indian hours overlaps with the entire UK morning and into the early afternoon. That is a genuinely shared working day, not a handover window.
In practice it means a question asked at 9am London gets answered the same morning, and work done in India overnight is waiting when you start. This is the single biggest advantage over a US-based arrangement, where the overlap is a couple of hours at the edges.
What to agree anyway: a fixed window when someone is definitely reachable, and what happens on Indian public holidays, which do not line up with British ones.
What to test for: UK regulatory knowledge
This is where offshore arrangements most often come unstuck, and it has nothing to do with skill at buying media.
UK advertising is self-regulated under the CAP Code and enforced by the ASA, which works with the platforms. A ruling means your ad stops and the reasoning is published under your company's name. Claims need substantiation held before they run, prices must include mandatory charges, and testimonials must be genuine and typical.
On top of that sit sector rules. Finance, health and gambling each carry additional requirements, and financial promotions need authorisation or approval before they can be made to UK consumers at all.
Ask the agency directly what the CAP Code means for the claims in your draft ads. An agency that has worked properly in the UK will answer immediately. One that has not will talk about platform policies, which is a different and much weaker thing. We wrote up what the ASA actually polices in the CAP Code and your ad account.
Data protection and the contract
UK GDPR applies to your customers' data wherever it is processed. Transfers to India need a lawful basis — in practice, the International Data Transfer Agreement or the UK Addendum to the EU standard contractual clauses, plus a transfer risk assessment.
This is ordinary paperwork rather than an obstacle, and any agency working with UK clients should already have it. If the question produces confusion, that itself is informative. Your own legal adviser should review what they send; nothing here is legal advice.
Three other clauses are worth insisting on: you own the ad accounts, the pixel and the data; notice is reciprocal; and everything produced transfers to you on exit. The full list is in nine clauses that matter.
Paying for it
Invoices from an Indian agency to a UK business are normally an export of services, so Indian GST does not usually apply. On your side, the reverse charge mechanism typically applies for VAT. Both of those are general positions rather than advice — the treatment depends on your circumstances, and your accountant should confirm it before the first invoice rather than after.
Practically: agree the invoicing currency up front, decide who absorbs the transfer fee, and expect international payments to take a few working days. We set out the mechanics in paying an Indian agency from overseas.
What a good Indian marketing agency looks like after thirty days
You should be able to name the person running the account. There should be a shared document where decisions are recorded, because across a time difference anything agreed verbally evaporates. The first report should discuss decisions rather than display dashboards. And somebody on their side should have pushed back on something — a claim, a budget, a landing page — because an agency that agrees with everything across four and a half time zones is not paying attention.
We work with UK clients from Noida and set out how the engagement runs on the UK page.
Questions people ask before hiring
How many hours does India overlap with the UK?
India is four and a half hours ahead, so an Indian working day covers the whole UK morning and early afternoon. That is a shared working day rather than a handover window, which is the main practical advantage over hiring in the US.
Does an Indian agency need to know UK advertising rules?
Yes, and it is the most common gap. UK advertising is governed by the CAP Code and enforced by the ASA, with extra requirements in finance, health and gambling. Ask what the Code means for the claims in your draft ads and listen for whether the answer is specific.
What about UK GDPR when data goes to India?
UK GDPR applies wherever the data is processed, so transfers need a lawful mechanism such as the International Data Transfer Agreement or the UK Addendum, plus a transfer risk assessment. Any agency with UK clients should already have this; have your own adviser review it.
How does VAT work on an Indian agency invoice?
Services exported from India to a UK business are generally outside Indian GST, and the reverse charge usually applies on the UK side. Treatment depends on your circumstances, so confirm it with your accountant before the first invoice.
